INTRODUCTIONS - COMMITTEE AND STAFF MEMBERS:
PRJ05-00779 ZON05-00112. APPLICANTS: BECHTEL COMMUNICATIONS AND CINGULAR WIRELESS; PROPERTY OWNER: GING L. GIN.
A request for minor site plan approval of a wireless communications facility tower and related equipment on property located at 3121 Yorba Linda Boulevard (north side of Yorba Linda Boulevard, at the intersection of Sapphire Road) (C2- Zone) (Categorically exempt under Section 15301 of CEQA Guidelines) (AK)
Assistant Planner Kusch explained that the site is a single-story, L-shaped commercial center. The applicant is proposing to install a 53-foot tall cellular antenna designed as a tower. The plans show that the tower and equipment would be located in the parking area towards the rear of the property. The applicant has provided a photo simulation showing the tower in relationship to the front elevation. Previous approvals for the center mentioned security concerns with the use of the rear parking area. Staff noted Zoning Code deficiencies. The antenna, as proposed, would require a setback of 265 feet from Yorba Linda Boulevard and 53-feet from adjacent residential zone, located north of the property. The proposed setback is approximately 200 feet from Yorba Linda Boulevard and 50 feet from the adjacent residential zone. The Zoning Code requires a 5-foot setback to an arterial street (Yorba Linda Boulevard) for each foot in antenna height, and a setback of one foot from residential zones for each foot in antenna height.
The plans reflect a proposal to provide a sliding gate at the entrance to the back parking area. Because a water meter and an electrical transformer are also located in the parking area, Water Engineering expressed concern with closing off that area to public access.
Last year a Conditional Use Permit was revised for the center; at that time it was determined that the center would require 90 parking spaces based on the tenant mix. The center currently has a total of 70 spaces. This proposal would eliminate 8 of those parking spaces further reducing parking availability. However, the 8 spaces are not currently used because of security reasons. As proposed, the location does not meet the Zoning Code requirements as it relates to the height-distance requirements in relationship to the arterial street. Based on the proposed antenna location, the Zoning Code limits the tower to 40 feet.
Chairman Rosen asked staff to clarify whether the Conditional Use Permit recognized that those parking spaces were not going to be used and if there was any discussion about their permanent removal. Assistant Planner Kusch read an excerpt from the Staff Report for that Conditional Use Permit and no changes to the shared parking portion were proposed at that time.

Harold Faber, 3134 E. Palm Dr. #41 spoke in opposition of the proposal.
Mr. Faber said that there are some residential units that directly face the parking area, and the tower would be a visual blight. This particular location is not only impacted by trash, but graffiti and a major electrical transformer pad. Mr. Faber went on to say that recently a new tenant who operates a laundry business moved into the center. The owner of the laundry installed a sewer connection that runs through the parking area and ties into the Greentree Apartments sewer system. He stated that the sewer connection impacted the adjacent access road and was installed without the permission from the adjacent residents. He stated that he is doubtful that if the tower is approved as proposed that the signal strength would be sufficient enough to make a difference because of surrounding topography, and does not support the project.

Assistant Planner Kusch indicated that staff has received a number of calls and e-mails from neighbors who have concerns with the closeness of the tower to the neighboring residences; the effects of the electro-magnetic emissions from the antenna, the equipment noise, and the potential interference with television reception. Code Enforcement will address the trash issue.
Cathy Bardenstein representing Cingular Wireless stated that the site plan has not yet been revised to reflect the current proposal. The tower has been relocated from the parking area to the walkway between the two buildings.
Committee Member Rosen asked if Cingular could use the slim line type of tower. Ms. Bardenstein said the slim line does not typically work with Cingulars application.
Because of the unresolved issues with the proposal Chairman Rosen suggested that the project be continued.

PRJ04-00143 ZON04-00019. APPLICANT: CIE FRANZIA; PROPERTY OWNER: COCO PALMS.
A request to install vehicular security gates to a residential condominium complex on property located at the southeast corner of commonwealth and Acacia Avenues) (R-3 Zone) (Categorically exempt under Section 15301 of CEQA Guidelines) (HA)
Consultant Planner Abalos stated that the applicant proposes a 6-foot high fence/wall combination to surround the project to include four vehicular and four pedestrian gates. The three vehicular gates on Walnut and Commonwealth are proposed to be sliding gates and the gate off of Acacia would be a swinging gate.
Staff concerns are that seven resident parking spaces would be lost in order to install Gate A; that the existing guest parking would be inside the gated area as a result of the project instead of outside the gate as required by code unless there is a phone system; that the number of guest parking in the complex is inadequate (a visual inspection shows four carports that face Walnut and three open spaces along Acacia); that the public fire hydrant is located inside the gate rather than outside, and the amount of stacking that would occur at the entrance to the gates. The exit only signs shown on the plans are unclear.
Associate Planner Eastman said that adequate stacking distance wasnt being provided. He explained the concept of stacking and clarified Staffs concerns for the applicant. Chairman Rosen said it would be helpful to differentiate between the vehicular and the pedestrian areas. Committee Member Thompson suggested labeling the carports. Associate Planner Eastman thought if the spaces were to be removed it would make more sense to move the gate further down and create a U-shaped driveway. The entrance signs at each gate need to be identified as such. Also clarification is needed on the vehicular exiting. Committee Member Tabatabaee said man doors are the preferred means of pedestrian exits installed next to the sliding gates.
Committee Member Veronel asked what the difference is between the numbered gates and the lettered gates. Gate A is an entrance only; Gate B is exit only. Committee Member Eastman explained that all of the numbered gates are pedestrian only, and suggested that if stacking occurs that it be on the inside of the gate. Show actual dimension of the gate from the sidewalk.
Committee Member Thompson excused himself at 10:12 a.m.
Ms. Franzia said that if the guest parking was reduced from 16 to 12, nine spaces could be gained. Chairman Rosen said that staff would need a written proposal in terms of guest parking and show on the plans where that guest parking would be located. Ms. Franzia said that there has not been a problem with the amount of guest parking in the past, and asked if it would be possible to move some of the spaces to Acacia if 16 guest spaces are required. Chairman Rosen said staff would have to review the request against the current code requirements and recommended that this project be continued so that the applicant can meet with the planner to work out the details.

PRJ06-00014 ZON05-00123. APPLICANT: T-MOBILE AND TRILLIUM CONSULTING, INC. PROPERTY OWNER: ORANGETHORPE METHODIST CHURCH. A request to install a telecommunications antenna on the roof of an existing church located at 2351 West Orangethorpe Avenue (north side of Orangethorpe Avenue, between approximately 310 and 775 feet west of the northwest intersection of Orangethorpe Avenue and Gilbert street) (R-G zone) (Categorically exempt under Section 15332 of CEQA Guidelines) (AK)
Assistant Planner Kusch stated that the applicant is proposing to do a roof-mounted antenna at an existing church. The plans reflect an extension of the existing sanctuary roof towards the front of the church. It would include extending the parapet above the existing top of the roof, and providing some screening at the front. The plans also reflect that the extension would match in color and texture to the existing building. The proposed equipment would be at the exterior of the building on the east side. There is mechanical equipment located along the same side of the building that currently is walled off and screened with cypress trees. The equipment would be adjacent to that equipment and the wall would match the existing wall and landscaping. The applicant has provided a photo simulation.
John Austin representing T-Mobile said that the antennas would extend 5 feet above the parapet wall. The stain glass would also be extended. Chairman Rosen wondered if the stained glass extension is used to provide light. Mr. Austin replied that it would be decorative only. Committee Member Eastman said that the material and colors do not necessarily need to match and could be of a different color (complimentary or lighter). He also suggested removing the sharp edge from the screening wall to add to the interest of the building.
Committee Member Voronel said that the driveways may need to be reconstructed up to 10% of the total cost of the construction.
MOTION made by Committee Member Eastman, SECONDED by Committee Member Tabatabaee, and carried by all present to APPROVE PRJ06-00014 ZON05-00123 as conditioned below (Resolution No. 437).
- Provide an alternative, complimentary color for added screen materials.
- Provide rounded edges for proposed equipment enclosure to compliment the slight curved or bowed elevation of the sanctuary building.
- Place the following notes on submitted plans:
- Public Safety - (T-Mobile) recognizes that the frequencies used by the cellular facility located at (2351 West Orangethrope), Fullerton are extremely close to the frequencies used by the City of Fullerton for Public Safety. This proximity will require extraordinary comprehensive advanced planning and frequency coordination engineering measures to prevent interference, especially in the choice of frequencies and radio ancillary hardware. This is encouraged in the Best Practices Guide published by the Association of Public-Safety Communications Officials-International, Inc. (APCO), and as endorsed by the Federal Communications Commission (FCC). Prior to the issuance of any permits to install the facility, (T-Mobile) shall meet in good faith to coordinate the use of frequencies and equipment with the Communications Division of the Orange County Sheriff-Coroner Department to minimize, to the greatest extent possible, any interference with the Public Safety 800 MHz Countywide Coordinated Communications System (CCCS). Similar consideration shall be given to any other existing or proposed wireless communications facility that may be located on the subject property.
- 800 MHz Radio Frequency - At all times, (T-Mobile) shall not prevent the City of Fullerton from having adequate spectrum capacity on Citys 800 MHz radio frequency.
- Post-Installation Test - Before activating its facility, (T-Mobile) will submit to a post-installation test to confirm that advanced planning and frequency coordination of the facility does was successful in not interfering with the City of Fullerton Public Safety radio equipment. This test will be conducted by the Communications Division of the Orange County Sheriff-Coroners Department or a Division-approved contractor at the expense of (T-Mobile). This post installation testing process shall be repeated for every proposed frequency addition and/or change to confirm the intent of the frequency planning process has been met.
- 24-Hour Phone Number - (T-Mobile) shall provide a 24-hour phone number to which interference problems may be reported. This condition will also apply to all existing (T-Mobile) facilities in the City of Fullerton.
- Single Point of Contact - (T-Mobile) will provide a single point of contact in its Engineering and Maintenance Departments to insure continuity on all interference issues. The name, telephone number, fax number and e-mail address of that person shall be provided to Citys designated representative upon activation of the facility.
- Lessees or Other Users - (T-Mobile) shall insure that lessee or other user(s) shall comply with the terms and conditions of this permit, and shall be responsible for the failure of any lessee or other users under the control of (T-Mobile) to comply.
