INTRODUCTIONS - COMMITTEE AND STAFF MEMBERS:
PRJ04-00557 ZON04-00059. APPLICANT: J. D. ALLEN; PROPERTY OWNER: CARL SPRAGUE.
A request to allow a block wall in the side yard to exceed 4-0 in height on property located at 727 West Las Palmas Drive (between approximately 45 and 58 feet south of the Nelson Place centerline) (R-1-20 zone) (Categorically exempt under Section 15303 of CEQA Guidelines) (SMI/HSO).
This Minor Site Plan was to review a proposal for retaining walls that exceed the maximum 4-foot height allowance, by Code, within side and rear yard setbacks. It was staffs opinion that these walls were designed to enlarge the buildable area on the lot, therefore required a Minor Site Plan Review. Mr. Allen presented the project to the committee. A scaled model of the proposed site, including retaining walls, was displayed to demonstrate the need for retaining walls higher than 4 feet on the property. No neighbors were opposed to the project.
Along the south property line the retaining walls will reach a maximum height of 8 feet. These walls will be visible from the applicants side of the property. The owner plans to add a wrought iron fence on top of the retaining walls along this property line. The applicant and architect also mentioned possible future plans of the adjacent property owner (to the south) that may reduce the common slope, therefore reducing the retaining wall height to =/- 4-0 along this property line.
Along the north property line the access drive will be supported by a retaining wall that will reach a maximum of 7 feet tall. Due to a change in prior agreements with the adjacent property owner to the north, this proposed retaining wall has increased in height. Prior to this change, this retaining wall was not to exceed 4 feet, meeting the Zoning Code. This property owner has viewed these revised changes, and supports the 7 retaining wall.
Committee Member Wallin discussed the existing drainage on the property. The applicant explained how the proposed site was designed to work with the existing drainage of the land.
Committee Member Thompson said that the applicant must provide evidence of access to a fire hydrant within 150 feet from the street to any remote areas of the building or sprinkle all of the building. A fire access driveway and turn-a-round shall be provided. The bridge shall be constructed so as to accommodate the weight of an ambulance.
Chairman Rosen mentioned that the existing horse stable on the adjacent property must meet the 50-foot distance requirement from a habitable space (between the closest point of the proposed new house and the existing stable).
The Committee supported the project and made a motion to approve with the standard condition.
MOTION made, SECONDED, and CARRIED unanimously to APPROVE PRJ04-00557 ZON04-00059 (Resolution No. 371) as presented.
- All corrections generated through the plan check and inspection processes are incorporated by reference as conditions of approval. This will include any requirements generated by the Engineering Division.
There is a 10-day appeal period where any action by this Committee can be appealed to the Planning Commission and ultimately to the City Council. The request may be approved subject to conditions. Minutes of the hearing and a Resolution will be prepared.
