Persons addressing the Planning Commission shall be limited to 10 minutes unless an extension of time is granted by the Chairman, subject to approval of the Planning Commission. When any group of persons wishes to address the Commission, it shall be proper for the Chairman to request that a spokesman be chosen to represent the group.

Public comment will be allowed on agenda items at the time the item is considered.

Public comment will be allowed on matters not appearing on the agenda but within the Planning Commission's jurisdiction, at the end of the agenda. No action may be taken on off-agenda items except as provided by law.

The Planning Commission's approval or denial of any action on this agenda shall become final and effective ten days after its decision unless an appeal is made in writing within this ten-day period to the City Council by either an applicant or an opponent. The filing of an appeal within such time limit shall stay the effective date of the order of the Planning Commission until such time as the City Council has acted on the appeal. Anyone interested in making an appeal should contact the Development Services Department for assistance.

PUBLIC HEARINGS RECOMMENDED ACTIONS
  1. PRJ02-000140 / ZON02-00012 & ZON02-00013. APPLICANT: MICHAEL AFRAM; PROPERTY OWNER: ALLEN KLEIN. A request to construct a 10,543 square foot, two-story commercial building for use as a courier and delivery service for property located at 4130 West Commonwealth Avenue (south side of Commonwealth Avenue at the westerly extent of the Fullerton City boundary) (C-H zone) (Categorically exempt under Section 15332 of CEQA Guidelines).

  1. CONDITIONAL USE PERMIT CUP-773A. APPLICANT: ARMANDO RUIZ AND ASSOCIATES; PROPERTY OWNER: ROMAN CATHOLIC BISHOP OF THE DIOCESE OF ORANGE. A request to consider the findings and recommendations of a required traffic and parking study for the Rosary High/St. Juliana school sites, satisfying a condition of approval for a Conditional Use Permit CUP-773A, and thereby allowing the placement of a modular building containing three new classrooms on the campus of Rosary High School located at 1340 North Acacia Avenue (east side of Acacia Avenue between approximately 480 feet and 780 feet north of Melody Lane (R-1-10,000 zone) (Categorically exempt under Class 32 of CEQA Guidelines).   3. AGENDA FORECAST The next meeting of the FullertonPlanning Commission will be October 9, 2002, at 4:00 p.m. and 7:00 p.m. The September 25th meeting has been canceled.

    • A request to modify an existing CUP to allow an increase in enrollment from 76 children to 112 children for a child-care facility located at 1201 East Dorothy Lane (Continued from August 28, 2002).
    • A request to allow a reduction in the required parking for a proposed restaurant use on property located at 415 South Harbor Boulevard.
    • A request to allow a 640-square-foot limited second dwelling on property located at 440 West Malvern Avenue.
    • A request to allow the expansion of an existing church facility for a library and office use and a major site plan to consider a 3,000-square-foot addition, on property located at 643 West Malvern Avenue.
    • A request to consider revisions to the adopted zoning ordinance.
    • A request to consider creating a Restaurant Overlay District within the boundaries of the Central Business District.
    • A request to subdivide a 34,000-square-foot parcel into four lots on property located at 1340 Pico Street.
    • A request to change the land use designation from Low-Density Residential to Commercial and to change the zone classification from R-1-10,000 to C-1 and to consider site and architectural plans for a new, two-story 7,225-square-foot general office building on property located at 1601 North Harbor Boulevard.
